1. PRELIMINAY PROVISIONS

The present conditions of purchase apply to all sales of items of the brand Folders Co., which have been made through the website www.foldersco.com (hereinafter "website").

When placing an order, you guarantee that you are over 18 years of age and have the legal capacity to enter into binding contracts.

We reserve the right to cancel fraudulent, false or speculative orders as well as those orders that have been requested by any customer with which there may be any difference/controversy in previous orders, or when there are reasonable doubts that may make us think that the customer is violating any of the specified conditions of purchase or is engaging in any criminal activity.

We may update the present conditions of purchase as well as the legal warning at any time. You can always consult and print the updated version of both texts by clicking the links "Terms of Purchase" and "Legal Warning". 

1.1.User Obligations

As a user you are obliged to communicate to Folders Co. all the necessary data for access and use of the services of this website. These must be truthful and current and consent that we can make use of them to contact you if necessary.

It is essential that you provide all the information that we catalog as mandatory, because if we do not we will not be able to take your order. We will not be responsible in any case of possible delays or failures in the delivery as a result of the error or omission of this data.

The user must make appropriate use of the services included in the website, always in accordance with the legal system and will not carry out any activity that hinders or interferes with its operation. 

1.2.Security Measures

We will establish all reasonable mechanisms within our reach to ensure that your personal data is safely preserved at all times. However, you agree that no data transmission over the Internet can be guaranteed as safe from access by unauthorized recipients and can not be held responsible for any security breach unless it is due to our negligence.

Likewise, you must take the necessary security measures, both personal and material, to maintain the confidentiality of your username and password and notify us immediately of the loss, misplacement, theft, illegitimate access of your username and password, as well as their knowledge by third persons. 

2. CONDITIONS APPLICABLE TO ORDERS

All products offered on this website are sold directly by JCV Puff & Glass S.L. (Hereinafter JCV), with VAT number B54987730 and domicile at St/ La Torre, 51 under, Zip Code 03204, Elche (Alicante) SPAIN. 

2.1.Purchase Procedure

You can browse the website until you find the desired article. Once located, clicking on it will access all the detailed information offered by the website. From there you can add the item to your purchase.

In the case of a registered user with an active account, you must enter your email and password and the system will recognize your data.

Once in your account you can continue your purchase and finally confirm the order. 

2.2.Supply Coverage

The delivery zones of these articles are limited to any part of the world, provided the corresponding shipping costs have been paid.

In case of international orders (outside Spanish territory) or to special Spanish territories (Canary Islands, Ceuta and Melilla) the price of the article will not include any local taxes or derived customs charges.

These derived costs will be the sole responsibility of the buyer and recommended to be consulted with the relevant local authorities. 

2.3.Availability

All orders are subject to availability. We are not responsible for the lack of existence or unavailability of the products.

If a product is not available once the order is placed, it will be informed as soon as possible by email or by telephone and it will be canceled.

2.4.Contract with JCV and acceptance of orders

The order will not be accepted by us until the amount has been charged to your account and confirmed by our bank. After confirming the purchase, you will receive an email as an acknowledgment of receipt, but this will not imply that the order has been accepted, as they will be subject to our subsequent verification and acceptance.

We will confirm the acceptance of the order in an email in which we will inform you that the order is being sent. Only then will the contract between you and us be formalized, and only for the items listed on that shipping confirmation. 

2.5.Confirmation and cancellation of orders

Prior to the completion of the order on the website, you can review all the details associated with it (amounts disaggregated in all necessary headings - taxes, transportation costs, selection of articles, etc.), and can correct which it deems necessary.

After the confirmation, it will not be possible to modify or cancel the order through the website. In that case, the order can only be modified or canceled if the garment has not entered the shipping stage from our warehouses. 

2.6.Currency, taxes and price

In accordance with current legislation, all purchases from our website will be subject to value added tax. The applicable rate will be the legally valid at any time.

All prices are shown in euros (€) and should be considered as the final price to be paid by the customer. The transport costs (if applicable), as well as the taxes and tariffs for the entry and exit of the product in Canary Islands, Ceuta, Melilla and international territories are not included in this price.

The cost of transport will be added in the last stage of purchase.

The client must assume the taxes and expenses of entry and exit of the product in his Country/Community/Autonomous City (IGIC for Canary Islands, customs offices, etc.). These expenses must be paid directly by the customer to the logistics operator responsible for the delivery of the product. In the same way, the client must assume the cost of the exit of the product of his community (customs offices) when the return of the order is made. 

2.7.Method of payment and security

Any order placed must be paid immediately after the order confirmation. Only orders for which it has been completed and verified payment of the same will be processed.

Payment must be made through credit and debit card or through PayPal.

For security reasons, if you choose PayPal as payment method, once the order is placed, it is not allowed to make any change in the shipping address.

In order to guarantee the confidentiality and integrity of transactions, they are performed through the Secura Socket Layer (SSL) protocol with 128-bit security keys.

The charge will be carried out in real time through this payment gateway. In the event that the charge can not be finally carried out (for any reason), the order will be automatically canceled. 

2.8.Deliveries: types, deadlines and problems

The delivery can be made in the address you choose (except in PO Box).

The home delivery of the orders will be made by a logistic operator during the normal working hours at the address indicated by you when ordering. If there is no one in that address when the logistic operator comes, this will leave you a note and your customer service department will try to contact you to close the delivery.

The usual delivery time will be approximately 24/72 hours after the order is approved for national orders (Except Canarias, Ceuta, Melilla and Baleares) and from 5 to 14 working days for international orders or to the following national destinations: Baleares, Canarias, Ceuta and Melilla. This period may increase during periods of rebates, Christmas campaigns or in case of customs or other circumstances arising from (for information only) geographical distance, weather conditions, wars, strikes, any form of government intervention, breaches of our suppliers, etc. as well as any other attributable to the logistic operator in charge of the delivery of the product. We are not responsible for any delays that may arise from any of the reasons mentioned above.

The transport costs will be calculated for each case in the final step of the purchase, depending on the products selected and the geographical area of shipping.

If, at the time of delivery, the packaging of the order is damaged, you must open the package in the presence of the logistics operator to check the status of the items. If damage is observed you must detail them on the delivery note and contact us. We will repair or replace at no cost to you any items that have been damaged or lost during transportation, as long as you notify us of the incident as soon as possible. Please note that orders will be weighed for delivery before dispatch.

Once the order has been delivered, it will become part of your property and therefore, all damages that may originate will be your responsibility. 

2.9.Warranty and product information

The products we present on our website are a careful selection of our collection. We have put special care in showing with great precision the colors and characteristics of our products. Of course, the calibration of each monitor is different, and we can not guarantee that your monitor displays the colors with complete accuracy.

We work to try to offer our customers the maximum accuracy and reliability of the information detailed in the website (appellations, properties of products, photographs, etc.), but we are not responsible for potential errors that may exist. All the graphic material as well as the descriptions are offered for information. In this sense, we can correct errors or omissions in the website without generating any responsibility. 

2.11.Legal right to withdraw the purchase

In general, if the User contracts as a consumer and user, he has the right to withdraw from this contract within fourteen (14) calendar days.

This term will expire once the fourteen (14) calendar days have elapsed since the day on which the User is delivered the requested item.

In order to exercise its right to withdraw, the User must send notification to JCV, by email to the e-mail address info@foldersco.com, in which the User unequivocally communicates his/her decision to desist from the contract signed between the User and JCV.

The user must comply with all the conditions of purchase and return contained in this document, and consequently, to exercise the right to withdraw purchase, the articles must meet the requirements mentioned in the SHIPPING AND RETURNS section.
